For those of you that have been following the coverage on SOPA (Stop on line piracy act), many who oppose the bill are getting together to have an internet "black-out" day. Large companies like google, yahoo, facebook, ect. are joining in to demonstrate what can happen to the internet if the bill passes the US congress and is signed into law. The bill was created to shut down websites that promote pirated material like movies, games, and music. The problem is the broad aspects of a bill that not only affect those sites (like pirate bay, btjunkie, torents.com) but any site even linking to a site that has content that may be pirated. ANYONE can shut the site down. The ISP, the cooperation that owns the copy-written content....and even just a regular every day guy who reports the the site. Since the activity is not considered "criminal" in the bill (although criminal charges can be filed), there is no initial due process. Meaning, in theory, a site can be reported and shut down the same day without notice. Then the site owner would have to appeal, which could take from days to months.

It also says in the bill that the content does not have to be posted or approved by the site owner, but also covers users in their replies or posts. Example: If someone was to just leave a comment in any thread on this site with either a link to a torrent or the web address to a torrent site or even to a site that has "some" torrents....this site would be shut down. If they even posted a photo that is has copy-write protection...same thing. I would not be contacted regarding the content so I could remove it.....but they would just shut the site completely down, no questions asked. If someone posted a photo on FB that is considered to be copy written......FB goes down.

As the laws are stated now, sites like this one, facebook, youtube, 4chan, google+...anything that relies mainly on user content, are protected by the "safe harbor law" if someone posts any illegal activity. So as of now if someone was to post a torrent link on FB and it is reported, the worst case is FB would have the option to remove the content and/or the user....but are still not personally responsible as long as they state in their TOS that it is against policy to post such things. If this law passes, the sites will be completely responsible for ANY content posted....even by its users.

I'm sure you can see the writing on the wall and understand this will lead to complete government and large corperation control of the internet. That can not happen.

It's sad, Congress is trying to turn this into some form of totalitarian country, trying to put everyone on as short a leash as possible..

Thankfully their efforts are being shot down, but how long will that stand?

I believe in the idea of protecting copy-right owners from content sharing without permission, but i think the idea of those sharing a link to illegal websites being legally shut down is stupid. For two reasons:

1. As you said, the entire internet will be down pretty soon. Google will be screwed.
2. Also, if a website is found to have a link to an illegal website, wouldn't it make more sense to just shut down the illegal website, so the link can't be used?

That's the issue, it's corporate censorship. But they really can't "shut down" the website. All they can do is block the domain name. So you would still be able to connect to the site via its IP address. Their goal is to "block" domains that host/promote illegal material. I get that. But they purposely put the clause in that they could also block any site that links to a site that hosts illegal content so they can control the internets content.


Perfect example of how this can (and would) be used. Lets say I opened a painting business out of my house and made an website. And I took some money and promoted the business on TV and/or radio aside with using local ad services on things like facebook, google, and you tube. And by doing that my business started to grow. In reality, any job I landed would be 1 less job an established painting business in my area got. In theory if my site (having only to do with painting) had the ability to publicly display user content......the established business could "plant" a link, make a call, and have my site blocked..... which in turn would be a tool to "kill" my business. It may sound like a far fetched story....but that is exactly the kind of thing this will be used for, just in a larger scale. Not that they would, but people like Amazon could plant things against other retail sites in the comment sections to kill competition. Ebay could do it against any auction sites. And even those roles could be reversed. If I wanted to start a retail site, Amazon would be the one that would need to "go" so their customer base could trickle down to other sites....giving me a better chance for a customer base to grow out of the newly created "customer pool".

This all really as nothing to do with illegal file sharing. This is about corporate and government control of the internet.

So I've seen this blow up all over the place, and I just can't get to care about it. I mean if it is as bad as it seems, even if it passes, it's use is probably getting blown up out of proportion and they'll eventually change it or not apply it or whatever. It feels like the patriot act in that it was going TO CHANGE THE WAY AMERICANS LIVE FOREVER STRIP THEM OF THEIR LIBERTIES AND CRUSH THE AMERICAN SPIRIT and then went ahead and it changed nothing for the average american. I mean, I get it, it needs to be fought, and I admire that, but if the law is THAT bad it can't work out on its own.


On the other hand, can someone explain me how this is going to affect me and my fellow nonamericans? I get it, they can shut sites down and whatnot, but sites can be hosted elsewhere (read: the sites I use the most probably have the cash to move somewhere else) and then it's only american ISPs blocking the domain, which does not affect non-americans. Or am I reading this wrong? How could they possibly block a site in Mexico when the site is not hosted in the US and the law doesn't apply here. Block an american-owned domain and a new one can be slapped on a site for a few bucks.

In theory it will affect every country that has sites that depend, even partially, on US members. Lets say Youtube for example. With over 100 million viewers in 2009, the advertising income would take a tremendous impact if you were to lose that kind of revenue. Or facebook. Only 30% of the users are from the US (although an assumption that more then 30% of their cash flow comes from here), but if facebook was blocked here, and they lost that kind of base, then it is more-then-likely every country would be affected whether it being the sites could no longer afford to stay afloat, or they would not be able to afford progression and innovation like they have the opportunities they do now. It also would harm the US economy, in turn having more of a cause and effect elsewhere.

It may not affect directly the every day user in a daily noticeable manor, but it's the larger picture. Any other country hosting sites that rely in any way on US advertisements or members could be affected. Advertisers pay due to the amount to traffic to a site.....if that drops, the money drops. If the advertising money drops then the site owners make less so either offer less, or offer nothing at all. This also affects the companies who advertise....some of them small businesses.

It has the potential to be a trickle down effect.

As far as the patriot act and the more recent defense authorization act, i admit the media hyped the effects it would have on the every day citizen, but the impact is still there. It's just not as broad as they claimed it would be. But the facts are it is noticeable, inconvenient, and at times is a hindrance to some Americans daily life. Just like I said about SOPA, it doesn't affect everyone "directly".....and there are some who won't notice.....but the total effect and impact could completely change how the internet does business.....in turn affecting every country.

If this does pass in the US, there is no question the government here has a complete disconnect with our people.....in change opening a broader door in censorship here and maybe across continents. The big difference b/w this and the patriot act was that was partially supported by the american people....SOPA is only supported by big business. If it passes, it will set a trend on who actually has a voice in what happens here...... potentially creating a new type of governing body in the US. Although it "seems" now that big business runs everything, this would be the 1st "proof".

if you haven't read 1984, you should do so. definitely worth reading, and that kind of future is exactly where we're headed if this corporate reign of terror doesn't end. the same thing goes for gaming companies who recently updated their ToS so you're forced to waive your right to sue if you want online play. bullshit, right?

But would websites be penalised if a member or user who is totally unaffiliated with them posted a link or content? And how far down the line could it go? Like, a link to a link to a link? I still don't understand how it makes sense to shut down a website which has a link to another, instead of or as well as, the illegal site?

But especially now the presidential campaining has started, one would think the government would be making popular changes? It has really been hyped up here as a negative bill. Although hasn't really had much media coverage.
